Terms and Guidelines

1. General
1.1. PIXIT Website (“PIXIT”, “website operators”) is activated by Pixit photo products Ltd. It offers a range of photo-embedded products, which you can order through a designated program which can be downloaded from the site for free.
1.2. This Agreement is formulated in male for convenience sake, but applies to both males and females.
1.3. These terms apply to every activity / order which will take place through the site. Any activity, including downloads, uploads and product orders, indicates your accepting these terms of use and consent to be bound by them.
1.4. Website operators reserve the right to modify parts of this Agreement from time to time. An updated version can be found on the website. The updated version is the one to determine at the given date.

1.6. Any legal or other litigation regarding this Agreement will be done under the laws of the State of Israel only.

2. Content
2.1. Uploading content onto the site is by no way a form of transmitting right of possession and the website operators are not responsible in any way for the storage, protection or any other aspect of the content’s possession.
2.2. Pixit does its best to assure the material uploaded on to the website is safe and intact. However, it is recommended and advisable for the user to backup all content uploaded, just in case. Pixit is not and will not be held responsible in any way for material that has been damaged, deleted, lost, stolen or destroyed in any way and will not be responsible for any law-suit and/or damage and/or loss of information and/or grief, either direct or indirect.
2.3. Content damaged before product production and that can’t be restored will refund the customer with the total amount paid for the production.
2.4. Updated content will be saved for as long as it takes to produce it and provide it to the customer. It is therefore recommended to save backups of ordered products for future orders.
2.5. Website operators maintain the right to block, prevent use and cancel participation of users who will exceed from the terms of this Agreement.
2.6. User of this website is responsible for all content uploaded/written by him, including content included in the ordered products.
2.6.1. The uploading of any illegal content; racist, threatening, profane or pornographic material, material that constitutes ground for a civil law-suit, libel or slander, material that violates the right to privacy, that may provoke criminal behavior, that violates in any way the order of any law including the law against slander 1965 – are strictly forbidden.
2.6.2.  Any content protected by copyright – is strictly forbidden, except for cases in which the user holds legal certifications for his ownership of the spoken content. Anyone who uploads content onto the website hereby declares that he is the owner of copyright to that content and/or has gotten appropriate authorization from the rightful owner. Anyone who uploads content onto the website hereby bestows power of attorney to the website operators to pass to him any law-suit in the matter and therefore remove any responsibility from them.
2.7. Pixit cannot supervise on all the products and content ordered through the site, but does its best to immediately delete any content that does not stand in line with the specified in item 2.6. Website operators will not be held responsible for any damage that might take place as a result of such content. Website operators maintain the right to claim reimbursement/compensation for any damage caused to them, their employees, their customers or any third party by the result of violation of item 2.6.

3. Software and Software Support
3.1. Pixit website enables free access and use of the software. Downloading and installing the software means accepting all terms of this Agreement and is binding in all its items.
3.2. Pixit software is installable for free and permitted for free private or business use. Nevertheless, it is strictly forbidden to perform any changes in the software, merge it with any other software, perform actions of Reverse Engineering, sell user rights, distribute under another name, translate, and/or perform any use that exceeds software definition: a tool for designing and ordering picture products through Pixit website.
3.3. Pixit will distribute updates for the software once in a while, with no obligation for advanced notice. The updated version of the software will be available at the company website. The updated version will include, among other things, a price-list, valid from the day of the software distribution. In any case of dispute – the price-list published on the site on the date of the order, will be the one to determine.
3.4. Pixit software is hereby usable as is. Pixit will do its best to assist in support and counseling regarding any aspect of using the software. Using the software will not constitute ground for any claim or suit against Pixit relating to any of the offered services, abilities and/or its influence on the computer or any other programs installed on it. The company is not responsible for any outcome that could be caused by installing and/or using the software.
3.5. Pixit will not, in any way, be responsible for any damage, direct or indirect, any loss of information, direct or indirect incomes or profits of any kind.
3.6. The intended use of the software – Pixit is hereby given for one purpose only – designing and ordering printed picture products and other products through the website PIXIT.CO.IL. Any other use of the software, for needs that exceed the license of use, are forbidden without explicit authorization from the website operators.

4. Limits of service
4.1. Pixit website operators present you with an up-to-date line of production that includes meticulous quality control. A product that looks defect is to be sent to our offices within 14 days of the delivery date, along with the purchase bill for examination. A defect product will be credited with the total amount paid for it to Pixit. The maximum rate of refund will not ascend the product cost as defined in Pixit price-list.
4.2. Termination of a bargain will be done accordingly with the instructions of the Law for Consumer Protection – 1981.
4.3. The prices of the products are modified from time to time and therefore before performing an order, you should update the software to make sure the price paid is the updated one.
4.4. Pixit will enable cancellation of orders that their manufacturing process hasn’t been started yet. Cancellation requests must be delivered by writing through the “Contact us” application on the website.
4.5. Pixit does its best to assure the ordered products reach their destination. However, it might occur that a delivery will not reach the addressee. In the case of loss of a package, Pixit will be responsible for producing and sending the ordered products once again, after receiving a confirmation of the loss from the sender. Pixit is in no way responsible for any damage, direct or indirect, that might occur to the customer due to loss of delivery or its arrival at a third party. In cases where the products ordered include confidential information, it is recommended to arrive at Pixit offices to coordinate personal pick-up. Pixit is not and will not be held responsible in any way for deliveries lost due to a wrong address.
4.6. Customer details and all of his uploaded files are password-protected and won’t be accessible to anyone besides company employees responsible for manufacturing the ordered products. Personal details, including credit card details, will be secured by SSL 128 bit protocol.
4.7. All customer details will be stored in the hands of the website operators and will not be passed to any third party without prior consent of the customer, except for cases in which it will be required by the law or for legal proceedings in which this information is necessary.
4.8. Ordering products through the software constitutes customer’s consent to regularly receive email messages from the website operators regarding innovations, offers and different announcements. Pixit will not pass the customer’s email address to any third party, except for cases in which it will be required to do so by the law or for legal proceedings.
4.9. Changes in specifications – Pixit constantly renovates and enriches its range of offered products, and reserves the right to modify the specifications from time to time without prior notice. An announcement on such modifications will be posted on the website and/or through email. The modifications will not apply for products already in manufacturing, but only for new orders sent after the publication of the changes.

5. Other
5.1. It is advised to perform a careful proof-reading before ordering the products, and to make sure that all texts, photos and formats are correct and fitting. Website operators will not be able to check and/or make changes in the products after they’ve been ordered.
5.2. Pixit will not be held responsible for any mistakes made by the customer, such as format mistakes, spelling errors, incomplete use of product pages and so on (see item 5.1).
5.3. We will indicate that a deviation of up to 20% between the colorfulness of the product as seen on the screen, compared with that in the final outcome, will not be regarded as defect and therefore will not constitute as grounds for the definition of a defect product.
